Duns Scotus's famous proposition was first attacked in a short polemical treatise attributed to Thomas of Sutton. By the time of Ockham, the proposition was known as the propositio famosa, so called by Walter Chatton, Ockham's colleague at Oxford and London, who defended it against Ockham's lengthy critique. At Paris, during the same period, it was called the propositio vulgata and was used approvingly by Francis of Meyronnes, Peter of Navarre and Durandus St. Pourçain. This “famous proposition” was so (...) controverted because on it depended the acceptance, with Duns Scotus, or the rejection, with Ockham, of theology as a strict, propter quid science. As its detractors and defenders must have realized, it also struck at the heart of the divergent philosophical outlooks of Duns Scotus and Ockham. For all of this, Duns Scotus's famous proposition and its history have all but escaped notice. (shrink)

My aim in this paper is fairly modest. I obviously do not claim that there has never been or could never be an instance of irrational or fallacious appeals to quotations from canonical sources in the marxist tradition. Instead, I claim that the practice of using quotations from canonical sources is not, as such, irrational. If we understand the epistemological infrastructure of the practice -- the rational underpinnings of it -- we can grasp how these citations appeal to the presumptive (...) authoritativeness of formulations that condense or concisely convey the core of insights that emerged from learning processes that the intellectual tradition of marxism has already traversed. The rational underpinnings of the practice include, first, the neo-Hegelian idea that we can justify a view we now hold by rationally reconstructing the insight-motivated learning process from which it emerged, and second, the convention that these rational reconstructions do not have to be elaborated in each insistence, but can be invoked in a short-form way, such as by citing the name of a decision or a concise statement of it (like a short quotation), as is common in the epistemologically similar practice of precedential reasoning in common law juridical justification. No claim is true just because of who made it; but a claim might be presumptively authoritative in cases where it was made at the end of a learning process, which has not been overtaken by a change in the circumstances or further learning. Resisting Corporate Corruption teaches business ethics in a manner very different from the philosophical and legal frameworks that dominate graduate schools. The book offers twenty-eight case studies and nine essays that cover a full range of business practice, controls and ethics issues. The essays discuss the nature of sound financial controls, root causes of the Financial Crisis, and the evolving nature of whistleblower protections. The cases are framed to instruct students in early identification of ethics problems and how to work (...) such issues within corporate organizations. They also provide would-be whistleblowers with instruction on the challenges they’d face, plus information on the legal protections, and outside supports available should they embark on that course. Some of the cases illustrate how ‘The Young are the Most Vulnerable,’ i.e. short service employees are most at risk of being sacrificed by an unethical firm. Other cases show the ethical dilemmas facing well-known CEOs and the alternatives they can employ to better combine ethical conduct and sound business strategy. Through these case studies, students should emerge with a practical toolkit that better enables them to follow their moral compass. Finally, the cases provide an in depth look at how a corporation becomes progressively corrupted (Enron), how the Financial Crisis was rooted in ethical decay at institutions as diverse as Countrywide, Goldman Sacks, Citigroup, Fannie Mae and Moody’s, and at the ethical challenges that persist in the post-Crisis, post-Dodd-Frank environment. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Hume's passing remark that his "ruling passion" was his "love of literary fame" has too easily encouraged the view that he gave up serious philosophizing after writing the _Treatise<D>. The most prominent casualty of this outlook is the first _Enquiry<D>. The article shows "the love of literary fame" to be an entirely appropriate motive for the serious intellectual writer, not an admission of frivolousness. Some further obstacles to taking the _Enquiry<D> seriously are considered, before a short sketch of the (...) _Enquiry<D>'s argument and context shows it to be, not a mere collection of essays, but a sustained argument which reveals the broad thrust of Hume's philosophical vision. Hebrews 4:15 says that Jesus was tempted like other human beings yet never sinned. Sinlessness is not the same as impeccability. Chalcedonian Christology or some variant of it seems necessary to show that Jesus was metaphysically unable to sin. Metaphysical impossibility to sin, though, appears to rule out temptation as experienced by ordinary human beings. This paper argues that Oliver D. Crisp, T. A. Hart, Brian Leftow, and Gerald O’Collins all fall short in trying to show how Jesus was (...) both impeccable and tempted as we are. (shrink)

This book traces one exegetical, interpretative principal, divine accommodation, in Jewish and Christian thought from the first to the nineteenth century. The focus is upon major figures and the place of accommodation in their work.

Background To determine whether fetal care paediatric and maternal–fetal medicine specialists harbour differing attitudes about pregnancy termination for congenital fetal conditions, their perceived responsibilities to pregnant women and fetuses, and the fetus as a patient and whether self-perceived primary responsibilities to fetuses and women and views about the fetus as a patient are associated with attitudes about clinical care.Methods Mail survey of 434 MFM and FCP specialists .Results MFMs were more likely than FCPs to disagree with these statements : ‘the (...) presence of a fetal abnormality is not an appropriate reason for a couple to consider pregnancy termination’ ; ‘the effects that a child born with disabilities might have on marital and family relationships is not an appropriate reason for a couple to consider pregnancy termination’ ; and ‘the cost of healthcare for the future child is not an appropriate reason for a couple to consider pregnancy termination’ . 65% MFMs versus 47% FCPs disagreed that their professional responsibility is to focus primarily on fetal well-being . Specialists did not differ regarding the fetus as a separate patient. Responses about self-perceived responsibility to focus on fetal well-being were associated with clinical practice attitudes.Conclusions Independent of demographic and sociopolitical characteristics, FCPs and MFMs possess divergent ethical sensitivities regarding pregnancy termination, pregnant women and fetuses, which may influence clinical care. Two prevailing paradigms explain the diversity of sex-determining modes in reptiles. Many researchers, particularly those who study reptiles, consider genetic and environmental sex-determining mechanisms to be fundamentally different, and that one can be demonstrated experimentally to the exclusion of the other. Other researchers, principally those who take a broader taxonomic perspective, argue that no clear boundaries exist between them. Indeed, we argue that genetic and environmental sex determination in reptiles should be seen as a continuum of states represented by species (...) whose sex is determined primarily by genotype, species where genetic and environmental mechanisms coexist and interact in lesser or greater measure to bring about sex phenotypes, and species where sex is determined primarily by environment. To do otherwise limits the scope of investigations into the transition between the two and reduces opportunities to use studies of reptiles to advance understanding of vertebrate sex determination generally. © 2004 Wiley Periodicals, Inc. The focus of this Perspective article is on the comparison of two of the most popular initial applicant screening methods: Resumes and application forms. The viewpoint offered is that application forms are superior to resumes during the initial applicant screening stage of selection. This viewpoint is supported in part based on criterion-related validity evidence that favors application forms over resumes. For example, the biographical data inventory, which can contain similar questions to those used in application forms, is one of the (...) most valid predictors of job performance, whereas job experience and years of education, which are often inferred from resumes and cover letters, are two of the least valid predictors of job performance. In addition to validity evidence, making decisions based on application forms as opposed to resumes is likely to help organizations defend against claims of discriminatory hiring while enhancing their ability to hire in a more diverse, equitable, and inclusive manner. For example, applicant names on resumes can lead to screening bias against members of identifiable subgroups, whereas an applicant’s name can be easily and automatically hidden from decision-makers when reviewing application forms. Despite these convincing arguments focused on applicant quality and diversity, a substantial research–practice gap regarding the use of resumes and cover letters remains. (shrink)

American universities are increasingly proactive in dealing with conflict of interest problems of their faculty. Changing social norms, publicized scandals, and more have made both university administrators and faculty extra alert to the dangers of faculty infidelity to their roles as teachers and scholars. Personal interests — both financial and non-financial — appear increasingly to pressure faculty to behave inappropriately. Most faculty members resist those pressures. Yet, enough conduct that either is, or appears to be, improper has occurred to prompt (...) the adoption by universities of an ever-more complex regulatory regime. This regime no longer relies primarily upon threats of after-the-fact punishment for gross deviations from professorial norms. Instead, universities have also enacted a wide array of in-advance restrictions. These include required disclosures by faculty members of certain private interests, prohibitions of specific faculty behavior, and specified instances in which faculty members must temporarily withdraw from their professorial roles in light of their private interests. This article draws especially upon the author’s experience at the University of California to illustrate the new system of regulation. (shrink)

Everyone knows what it is to feel a conflict between a ‘non-rational’ desire and reason, as e.g., when we want a second dish of ice cream but think it would be unwise to take it. In such cases we commonly think of our desires as unreasonable: they prompt us to perform some action contrary to our deliberations. Nevertheless, most of us assume that reason can move us: that simply recognizing an act as the most reasonable thing to do gives us (...) a motive to do it — even if in fact we do not perform that action. If we do not eat the second dish of ice cream we are disposed to think that we did not because we judged it unwise. If, on the other hand, we do eat the second dish, we are disposed to think we did because we were more strongly inclined toward eating than not eating, even though we were inclined toward refraining because we judged eating unwise. This is the position of the man on the street. It is the commonsensical notion of reason, motivation, and their relationship. (shrink)

But like Nicodemus, the secret disciple of Jesus, he never made a public declaration of his private (...) faith – which the orthodox would have deemed extremely radical. He hid his faith so well that scholars are still unravelling his personal beliefs. His one-time follower William Whiston attributed his policy of silence to simple, human fear and there must be some truth in this. Every day as a public figure and as the figurehead of British natural philosophy, Newton must have felt the tension of outwardly conforming to the Anglican Church, while inwardly denying much of its faith and practice. He was restricted by heresy laws, religious tests and the formidable opposition of public opinion. Heretics were seen as religiously subversive, socially dangerous and even morally debased. Moreover, the positions he enjoyed were dependent on public manifestations of religious and social orderliness. Sir Isaac had a lot to lose. Yet he knew the scriptural injunctions against hiding one's light under a bushel. Newton the believer was thus faced with the need to develop a modus vivendi whereby he could work within legal and social structures, while fulfilling the command to shine in a dark world. This paper recovers and assesses his strategies for reconciling these conflicting dynamics and, in so doing, will shed light on both the nature of Newton's faith and his agenda for natural philosophy. An elementary theory T in a language L is (strongly) finitely inseparable if the set of logically valid sentences of L and the set of T-finitely refutable sentences are recursively inseparable. In §1 we establish a sufficient condition for the elementary theory of a class of BA's with operators to be finitely inseparable. This is done using the methods developed independently by M. Rabin and D. Scott (see [6]) on the one hand and by Ershov on the other (see [2]).

This article addresses whether cardiopulmonary resuscitation and sustained physiological support should ever be permitted in individuals who are diagnosed as brain dead and who had held previously expressed moral or religious objections to the currently accepted criteria for such a determination. It contrasts how requests for care would normally be treated in cases involving a brain-dead individual with previously expressed wishes to donate and a similarly diagnosed individual with previously expressed beliefs that did not conform to a brain-based conception of (...) death. The paper first focuses narrowly on requests for CPR and then expands its scope to address extended physiological support. It describes how refusing the brain-dead non-donor's requests for either CPR or extended support would represent enduring harm to the antemortem or previously autonomous individual by negating their beliefs and self-identity. The paper subsequently discusses potential implications of policy that would allow greater accommodations to those with conscientious objections to currently accepted brain-based death criteria, such as for cost, insurance, higher brain formulations and bedside communication. The conclusion is that granting wider latitude to personal conceptions around the definition of death, rather than forcing a contested definition on those with valid moral and religious objections, would benefit both individuals and society.
